Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Active K9 Training Solutions website or enrolling in any training service (the “Service”) offered by Active K9 Training Solutions (“Company,” “We,” “Us,” or “Our”). By accessing the website, booking a consultation, or enrolling in any service, You agree to be bound by these Terms. If You do not agree, You may not use the Service.
1. Definitions
Company refers to Active K9 Training Solutions, a dog training business located in Phoenix, Arizona, United States.
Service refers to the website, training programs, consultations, board & train services, and any associated materials.
You means the individual accessing or using the Service, and, where applicable, the owner or legal custodian of the dog enrolled in services.
2. Eligibility and Acknowledgment
These Terms govern Your use of the Service. You represent that You are at least 18 years old, or are accessing the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on Your behalf. Your access to and use of the Service is conditioned on Your acceptance of these Terms.
3. Description of Services
The Company offers private, individualized dog training services in the Phoenix, Arizona area, including Board & Train, Private Training, Puppy Training, Advanced Obedience, and Behavior Modification. The Company does not offer group classes. Services are provided by appointment only.
4. Assumption of Risk
You acknowledge that dog training, handling, boarding, and related activities involve inherent risks, including but not limited to bites, scratches, escape, property damage, injury to persons or other animals, and unpredictable animal behavior. You voluntarily assume all such risks in connection with Your and Your dog’s participation in the Service, whether arising from Your dog’s behavior, another dog’s behavior, or otherwise.
During Board & Train services, Your dog will live in a home environment and may interact with the training environment, equipment, vehicles, and other animals. While reasonable precautions are taken, the Company cannot guarantee against injury, illness, stress, or behavioral changes that may occur during this process.
5. Training Services Disclaimer
By enrolling in any training service, You acknowledge and agree that:
- Results vary depending on the dog’s temperament, history, environment, handler participation, and consistency of follow-through at home.
- No specific outcomes, behaviors, timelines, or results are guaranteed.
- You must follow all training instructions, handoff guidance, and safety recommendations provided by the Company.
- You are solely responsible for Your dog’s behavior during and after training, including any relapse due to inconsistent follow-through at home.
- The Company is not liable for injuries caused by Your dog before, during, or after training, for damage Your dog causes to property, people, or other animals, or for behavioral relapse resulting from lack of owner follow-through.
6. Owner Responsibilities and Disclosures
You agree to:
- Provide complete and accurate information about Your dog, including breed, age, and history.
- Disclose any history of aggression, biting, resource guarding, medical conditions, or other behavioral concerns prior to enrollment.
- Keep the Company informed of any changes in Your dog’s health or behavior during the course of services.
Failure to disclose relevant information may result in immediate termination of services without refund, and You may be held responsible for any resulting injury, damage, or liability.
7. Health and Vaccination Requirements
To protect the health and safety of all dogs and staff, Your dog must be current on required vaccinations, including Rabies, DHPP, and Bordetella, and proof of vaccination may be required prior to the start of services. The Company reserves the right to refuse or discontinue service at any time if a safety, health, or behavioral concern is identified.
8. Emergency Veterinary Care Authorization
During Board & Train or any service involving temporary custody of Your dog, in the event of injury, illness, or a medical emergency, the Company will make reasonable efforts to contact You or Your designated emergency contact immediately. If You cannot be reached in a timely manner, You authorize the Company to seek emergency veterinary care on Your dog’s behalf, at Your sole expense. You agree to reimburse the Company for all reasonable costs advanced for such care.
9. Appointments, Payments, and Cancellations
By booking a service, You agree to:
- Provide accurate information about Yourself and Your dog.
- Pay all fees as listed on the website or quoted directly, through the payment methods accepted at the time of booking.
- Understand that deposits are non-refundable unless otherwise stated in writing.
- Provide at least 24 hours’ notice to cancel or reschedule a session, unless a specific program states a different policy.
- No-shows or late cancellations may result in forfeiture of the session fee or deposit.
10. Photo, Video & Testimonial Release
By enrolling in our services, You grant Active K9 Training Solutions a non-exclusive, royalty-free, worldwide, perpetual license to photograph and record video of You and Your dog during training sessions, and to use such photos, videos, first names, dog names, and written testimonials for marketing and promotional purposes, including on our website and social media accounts (Instagram: @active_k9_training_solutions; YouTube), without additional compensation to You.
If You do not wish to participate, please notify Us in writing (including by email) prior to the start of services, and We will make reasonable efforts to exclude You and Your dog from future use and to remove previously posted content upon request.
11. Intellectual Property
All content provided through the Service — including text, graphics, videos, training materials, and branding — is the property of Active K9 Training Solutions and is protected by applicable intellectual property laws. You may not republish, reproduce, distribute, modify, or sell any Service content or training materials without Our prior written permission.
12. Links to Third-Party Websites
The Service may contain links to third-party websites or services not owned or controlled by the Company. We assume no responsibility for the content, privacy policies, or practices of any third-party site, and You agree that the Company is not liable for any damages arising from Your use of such sites.
13. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- The Company shall not be liable for loss of data, revenue, profits, or goodwill.
- Training outcomes are not guaranteed, and the Company is not responsible for ongoing or recurring behavior issues after services conclude.
- Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue use of the Service.
14. Release of Liability, Hold Harmless, and Indemnification
By using our training services, You release, waive, and agree to hold harmless Active K9 Training Solutions and its trainers, employees, and affiliates from any and all claims, damages, injuries, or losses arising from or related to: Your dog’s behavior; participation in training activities, evaluations, or board & train programs; transportation (if provided); and any interaction with other dogs, people, or property during the course of services, except to the extent caused by the Company’s gross negligence or willful misconduct.
You further agree to indemnify and defend the Company against any third-party claims arising from Your dog’s actions during or after the course of services. Nothing in this section limits liability arising from gross negligence, intentional misconduct, or any obligation that cannot legally be waived or excluded under Arizona law.
15. Dispute Resolution
If a dispute arises out of or relates to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally by contacting the other party in writing, including by email at activek9trainingsolutions@gmail.com. Nothing in this section limits either party’s right to bring a claim in small claims court.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any signed waiver or service agreement, constitute the entire agreement between You and the Company regarding the Service and supersede any prior agreements.
19. Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, extreme weather, illness, government action, or other circumstances beyond the Company’s control.
20. Termination
We may suspend or terminate Your access to the Service immediately, without prior notice, if You violate these Terms. Upon termination, Your right to use the Service ceases immediately, and no refund will be issued for services not yet rendered where termination results from Your violation of these Terms.
21. Changes to These Terms
We may update or modify these Terms at any time. Changes are effective immediately upon posting to this page. You are advised to review these Terms periodically.
